FAQ
Frequently asked questions
Answers for attorneys and paralegals considering a referral.
- What does Wolstein Medical Consulting do?
- WMC provides independent physician opinions for litigation: record reviews with a written opinion, independent medical examinations in New York and New Jersey, physician future-care assessments, and testimony about those opinions when a matter requires it.
- Who performs the work?
- Jesse Wolstein, M.D., a physician certified by the American Board of Emergency Medicine. He reviews the evidence, conducts any examination, and writes and signs every physician opinion.
- Where do you perform independent medical examinations?
- In New York and New Jersey only. For matters elsewhere, a record review may be an alternative.
- Can you review records for a matter outside New York and New Jersey?
- Record reviews and future-care assessments are available in other jurisdictions where permitted. Each out-of-state matter is screened individually at intake.
- What medical questions do you accept?
- Questions within Dr. Wolstein's training and experience in emergency medicine, such as whether emergency department evaluation and treatment met the standard of care, or whether documented injuries are consistent with the reported mechanism. If a matter needs a different specialty, WMC will say so at intake.
- How much does it cost?
- WMC does not publish a fee schedule. Each matter is quoted in writing after its scope, records volume, deadline and jurisdiction are confirmed.
- How long does a report take?
- Turnaround is agreed case by case once WMC has complete records and Dr. Wolstein has reviewed the scope. WMC acknowledges every referral within one business day.
- Do you work for plaintiffs or defendants?
- Both. WMC checks every matter for conflicts before accepting it.
- Should I send records with my referral?
- No. Please send only the referral form. Once WMC confirms scope and conflicts, you will receive a secure way to provide records.
- How should records be organized?
- Searchable PDFs are preferred, organized chronologically where possible. WMC's staff index the records and flag apparent gaps; they do not interpret medical content.
- Is a physician future-care assessment the same as a life care plan?
- No. It is a physician's opinion on future medical needs. It does not price future care and does not include vocational or economic analysis, which are separate services from separately identified professionals.
- Will Dr. Wolstein testify?
- Yes, when a matter requires it, about the opinions he has provided in that matter. Testimony terms are set out in writing in the engagement.
- Can you tell me in advance what the opinion will be?
- No. Opinions are formed only after the evidence is reviewed, and WMC's fees never depend on the outcome of a case.
- Does submitting the referral form create an engagement?
- No. An engagement begins only after WMC confirms scope, conflicts and availability and both sides agree to written engagement terms.
